§ 1 General provisions

1. These regulations (hereinafter "Regulations") define the rules for using tattoo services provided by the tattoo studio (hereinafter "Studio") and the website available at eldar-tattoo.pl ("Website").

2. The studio provides services involving the design and execution of tattoos (hereinafter "Treatments"). The condition for using the services is to read and accept the Regulations in advance.

3. Payment of the Deposit (specified in § 7) or participation in the Treatment is tantamount to acceptance of the Regulations. The Client is obliged to comply with the provisions of the Regulations from the moment of paying the Deposit or starting the Treatment.

4. In the field of reservations, electronic payments and personal data processing, the Studio acts as a service provider and data administrator. The website allows you to make reservations, pay a deposit, purchase vouchers and view sample works.

5. Detailed information on the principles of personal data processing can be found in the Privacy Policy published on the Website. By making a reservation or payment, the customer confirms that he or she has read this policy and accepts its provisions.

§ 2 Customer

1. The client of the Studio may be an adult natural person. The Studio allows the Treatment to be performed by persons over 16 years of age, provided that the written consent of the parent/legal guardian is obtained. The Studio reserves the right to verify the identity of the Client and guardian.

2. The client is obliged to provide current information about his/her health condition, including contraindications, infectious diseases, medications taken and allergies. In the event of concealment or provision of false information, the Studio is not responsible for the consequences of the Treatment.

3. The client declares that he has no health contraindications to getting a tattoo. In case of doubt, the tattoo artist has the right to request a certificate from a doctor confirming the lack of contraindications. The Studio may refuse to perform the Treatment if contraindications are found.

4. The client confirms that he is aware that: (a) the tattoo procedure is an interference with the skin, (b) the tattoo is permanent, (c) the intensity and clarity of the tattoo may change over time, (d) tattoos in places exposed to abrasion (e.g., hands, feet, knees, elbows) age faster. The studio is not responsible for these natural processes.

§ 3 Tattoo artist

1. The tattoo artist is properly trained and has the required permits and professional services. Before the procedure, the tattoo artist disinfects the work station, tools and hands; after the Treatment, these activities are repeated.

2. The tattoo artist is obliged to keep the hair, hands and nails in such a condition as to minimize the risk of scratches or cuts. During the treatment, he uses disposable needles, cartridges and reusable materials wrapped in foil.

3. The tattoo artist has the right to refuse to perform the Treatment if the Client does not follow the hygiene recommendations or lacks cooperation during the Treatment. In such a case, the deposit is non-refundable (subject to § 7).

§ 4 Studio

1. Smoking, e-cigarettes, alcohol and other intoxicants are strictly prohibited in the Studio.

2. It is forbidden to bring animals and children under 16 years of age into the Studio, unless the Tattoo Artist gives consent. The Studio has the right to refuse to bring an accompanying person to the Client or to ask the accompanying person to leave if their presence makes work difficult or constitutes a threat to hygiene.

3. The Client is responsible for damage caused to the Studio's property or caused by minors under his care. The studio is not responsible for items left outside the designated areas.

§ 5 Occupational health and safety

1. The tattoo artist is subject to health tests to eliminate diseases and infections that may expose the client to health damage. If the Tattoo Artist has an open wound, skin lesion or fever, he or she is excluded from providing services until the deviations are removed. In such a situation, the Studio will set a new date for the Treatment.

2. In the event of an injury to the Client during the Treatment or a sudden deterioration of well-being, the Tattoo Artist may interrupt the Treatment and postpone it to the next convenient date after consultation with the Client.

3. Only sterile needles and disposable materials are used during the Treatment. At the client's request, the studio provides packaging for disposable items.

§ 6 Customer's liability

1. The Studio is not responsible for the consequences of non-compliance with the Regulations by the Client or for side effects of the Treatment caused by concealing health contraindications.

2. The Client acknowledges that health complications may occur as a result of the Treatment (e.g., allergic reactions, scarring), and the Studio is not responsible for complications resulting from the individual reaction of the body.

3. The client undertakes to follow the tattoo artist's recommendations regarding tattoo care and use only recommended care products. The studio is not responsible for the consequences of failure to follow the recommendations.

§ 7 Reservation and deposit

1. The term "Deposit" is used within the meaning of Art. 394 of the Civil Code, which states that in the event of failure to perform the contract by one of the parties, the other party may withdraw from the contract and retain the deposit received. In the event of performance of the contract, the deposit is included in the remuneration due, and in the event of termination of the contract by the tattoo artist, it should be returned.

2. In order to reserve a date for the Treatment, the Customer is obliged to pay the deposit within 3 days of selecting the pattern or specifying the details of the Design. The amount of the deposit is determined individually, but cannot be lower than PLN 100.

3. The deposit can be paid in cash at the Studio, by bank transfer, BLIK, via the Website's electronic payment system (Przelewy24) or another method indicated by the Studio. The Studio is not responsible for delays in posting payments resulting from the operation of external systems.

4. The deposit serves as security. If the Client cancels the Treatment less than 7 days before the agreed date or fails to show up for the Treatment, the Deposit is forfeited and is used to cover the Studio's losses. The Client has the right to change the date of the Treatment once, informing the Studio no later than 7 days before the original date.

5. If the Treatment is canceled by the Studio or if the Treatment is not performed due to circumstances for which the Studio is responsible, the Deposit will be refunded.

6. In the case of a reservation made via the Website and concluding a distance contract, the Customer - as a consumer - has the right to withdraw from the contract within 14 days without giving a reason. The right to withdraw expires when work on the Project begins.

§ 8 Tattoo design

1. The studio makes tattoos based on designs available on the website, in social media or individually prepared ("Design").

2. In order to prepare the Design, the Client provides the Studio with information regarding size, place on the body, colors and style. The client is responsible for the legality of the provided material and for copyrights.

3. The Studio prepares one Project based on the collected information. In the event of significant changes to the concept, the Studio has the right to collect an additional deposit.

4. The studio does not copy other people's designs or tattoos of other artists. All designs and patterns prepared by the Studio are protected by copyright.

§ 9 Tattoo procedure

1. The Client confirms his/her presence for the Treatment no later than 12 hours before the scheduled date. Failure to confirm attendance is treated as resignation.

2. The tattoo artist has the right to refuse to perform the Treatment if he or she is more than 30 minutes late.

3. In case of serious health contraindications (infectious diseases, pregnancy, breastfeeding, epilepsy, HIV, HBV, HCV), the procedure will not be performed.

4. The studio does not perform treatments on people under the influence of alcohol or psychoactive substances.

§ 10 Payment and purchase of Vouchers

1. The price of the Treatment is determined individually. The client is obliged to pay the remaining part of the remuneration immediately after the completion of the Treatment.

2. The purchase of a Voucher entitles the recipient to use it for a Treatment in the Studio within the validity period of the Voucher. The minimum value of the Voucher is PLN 200.

3. The voucher is valid for 6 months from the date of purchase. Failure to make an appointment on time will result in the loss of the Voucher.

§ 11 Redeeming Vouchers

1. The person holding the Voucher is obliged to contact the Studio to arrange the date of the Treatment. On the day of the Treatment, the Voucher and ID document must be presented.

2. If the full value of the Voucher is not used, the difference will be forfeited.

§ 12 Tattoo care

1. After the Treatment, the Client is obliged to follow the rules of tattoo care included in the "Care Rules".

2. The studio is not responsible for complications resulting from failure to follow the recommendations.

§ 13 Complaints and corrections

1. The client has the right to submit a complaint within 14 days of the Treatment.

2. After the tattoo has healed (approx. 4‑6 weeks), the Client has the right to free correction of minor pigment defects within 6 months of the Treatment.

§ 14 Final provisions

1. The Studio reserves the right to change the Regulations for important reasons. The amended Regulations will be available on the Website and in the Studio.

2. In matters not regulated by the Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Act on Consumer Rights.

§ 15 Website, online payments and personal data processing

1. Using the Website requires providing personal data. The studio processes data in accordance with the GDPR regulation and its Privacy Policy.

2. The Studio uses the Przelewy24 payment service provided by PayPro S.A.

3. The website uses cookies for security, analytical and marketing purposes.

4. The customer has the right to access the data, rectify it, delete it and withdraw consent at any time.

5. The Studio may process the Client's image for promotional purposes only on the basis of a separate consent.
